End User License Agreement

IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY. This End User License Agreement (“Agreement”) is a legal contract between PitaLite Kiosk (“Company,” “we,” or “us”) and the entity or person (“Licensee” or “you”) registering for or using the PitaLite Kiosk (the “Software”).

1. Grant of License

The Company grants you a non-exclusive, non-transferable, limited license to install and use the Software solely on authorized self-serve kiosk hardware owned or controlled by you, for the internal business purpose of facilitating customer orders and payments.

2. Restrictions

You agree not to:

• Decompile, reverse engineer, or attempt to derive the source code of the Software.

• Sublicense, rent, lease, or lend the Software to third parties.

• Modify or create derivative works based on the Software.

• Use the Software for any illegal activity, including unauthorized data harvesting.

3. Hardware & Maintenance

• Compatibility: You are responsible for ensuring your kiosk hardware meets the minimum technical specifications required by the Software.

• Connectivity: The Software requires a stable internet connection. The Company is not responsible for order failures or payment processing errors caused by local network outages.

• Updates: We may periodically issue automatic updates. Failure to allow updates may result in Software malfunction or security vulnerabilities.

4. Payments & PCI Compliance

If the Software facilitates financial transactions:

• The Software integrates with third-party payment gateways (e.g., Stripe, Square). You must maintain an active account with these providers.

• Liability: We are not liable for chargebacks, fraudulent transactions, or payment disputes between you and your customers.

5. Data Privacy

• Customer Data: You are the "Data Controller" for any customer information collected. You agree to maintain a privacy policy that complies with local laws (e.g., GDPR, CCPA).

• Usage Data: The Company may collect anonymized telemetry data to improve Software performance.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR COMPANY NAME] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Termination

This license is effective until terminated. We reserve the right to terminate this license immediately if you breach any terms. Upon termination, you must cease all use of the Software and delete it from your hardware.
